Lease agreements & rental collection

In order to protect your investment, it is important to start with a good lease agreement, to properly vett the prospective tenant and thereafter ensure that all defaults by your tenant are handled promptly. We are available to assist you with this process and to take legal action to recover arrear rental and to evict the occupiers of your property where this becomes necessary.

Evictions

Unlawful occupiers of residential properties can only be evicted by way of a court order by a competent court in terms of the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act 19 of 1998 and from agricultural properties in terms of the Extension of Security of Tenure Act 62 of 1997. These Acts provide a complex process for evicting unlawful occupiers, which, if not handled correctly, will result in lost revenue for an extended period and cost you money in wasted legal fees.

Spoliation

Where one is in peaceful and undisturbed possession of immovable property, movable property or even services to a property, and one is deprived of possession unlawfully, you can apply to court for an order in terms of the mandament van spolie to have possession restored. Not only is it an offence to evict an occupier of immovable property in terms of Prevention of Illegal Eviction from and Unlawful Occupation of Land Act 19 of 1998, but an occupier may utilise this remedy to regain possession of a property from which they have been forcefully removed without a court order.
