Bail applications

Once arrested, bail can be applied for in the following circumstances:

1) in terms of Section 59(1)(a) of the Criminal Procedure Act 51 of 1977, an accused may be released on police bail before the accused’s appearance in court after consultation with a police officer of or above the rank of non-commissioned officer and after the payment of an amount determined by such police official. Police bail is only available for minor offences.

2) In terms of Section 59A of the CPA, an accused person may be released on prosecutor bail for more serious offences before the accused’s appearance in court. Such application has to be made to a prosecutor authorised by the Director of Public Prosecutions.

3) In terms of Section 60 of the CPA and should the interests of justice so permit, an accused person is entitled to be released on bail by a court at any time before conviction
