Antenuptial & Postnuptial Contracts

Antenuptial contracts are entered into before marriage with the objective of changing your property regime from the default position of in community of property to out of community of property or out of community of property with the application of the accrual system. Our attorneys are available to advise you on the many aspects of the different property regimes, in order that you are able to make an informed decision on which is most suitable in your situation.

Antenuptial contracts are signed before a notary and registered in the Deeds Office. Postnuptial contracts are entered into after marriage and need to be authorised by the High Court before they can be registered in the Deeds Office.

Divorce

A divorce may be granted on a number of grounds, the primary of which is the irretrievable breakdown of the marriage. The proprietary consequences of a divorce on the estate/estates of the parties will depend on the marital property regime, the terms of any contract entered into between the parties, claims for the redistribution of assets and claims of forfeiture. Besides the proprietary consequences, it is important to consider the best interests of the minor children born of the marriage when considering the care of and contact with the child, spousal and child maintenance and the prospects of resolving disputes between the parties.

Minor Children – Maintenance, Care & Contact

The Maintenance Court, Children’s Court, Regional Magistrates Court and the High Court are available to deal with maintenance matters and to protect the best interests of the child in dealing with care, guardianship and other matters relating to the minor child.

Whether you require spousal and / or child maintenance pendente lite during the course of divorce proceedings, maintenance for a child after divorce or in respect of yourself or a child where there was no marriage relationship, we are here to assist you in ensuring that you and your child’s maintenance needs are met.

Protection Orders

Whether you are / have been in a relationship with the person against whom you require a protection order in terms of the Domestic Violence Act 116 of 1998 or whether there is no such relationship and you require a protection order in terms of the Protection from Harassment Act 17 of 2011, we are here to assist you with an application for an interim protection order to protect your immediate safety, amongst other interests, and to represent you throughout such proceedings
