Civil Litigation

Civil litigation is the process by which civil matters are resolved in court. A simplified way of understanding what constitutes a civil matter is that it is not a criminal matter and involves a claim between at least two parties.

Such matters include, but are not limited to, claims for the enforcement of a contract, damages as a result of a breach thereof and claims for damages resulting from an injury to your person, property, rights and reputation.

Civil claims are initiated by way of application or action proceedings, depending on whether a material dispute of fact can be reasonably foreseen.

Breach of Contract

A breach of contract occurs when a party to a contract fails to honour their obligations under a contract without lawful reason. The remedies available to the innocent party depend on the nature and severity of the breach and the terms of the contract. The remedies are aimed at either the fulfilment of the contract or the cancellation thereof with/without damages.

Before you act on a breach by another party to a contract, it is important to consult with our attorneys and to obtain legal advice. Taking the incorrect action when faced with an apparent breach, may result in you being in breach yourself or your actions may amount to a repudiation of the contract.

Damage caused by the wrongful and culpable act of another

The law of delict aims to redress civil wrongs. A delict occurs where the wrongful and culpable act or ommission of another causes a reduction in your financial position or infringes on a personality interest. Should you have suffered a wrong at the hands of another, your remedy will lie in a claim for damages against such person/enity.

A claim for damages in delict can arise in a vast scenario of circumstances, including, but not restricted to:

  • Damage to property: motor vehicle collisions, malicious legal proceedings, the failure of a municipality to repair a pothole, misstatement on a company prospectus, unlawful competition, product liability, etc

  • Injury to the person: medical negligence, personal injury or death as a result of a dog bite, assault, wrongful arrest and detention, a failure by the police to provide adequate protection, defamation, invasion of privacy etc.
